Welcome to Airspot and thank you for joining the Airspot Community. BY ACCESSING THE AIRSPOT COMMUNITY, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS FOR USE OF Airspot SERVICES (“T&Cs”).
Airspot reserves the right to modify, at any moment, in accordance with clause 15.4, the whole or partial contents of these T&Cs.
Definitions
- Airspot: A registered publicly accessible WiFi hotspot location where router has been installed.
- Airspot Router: The Router that provides you with the Airspot network and its services.
- Airspot Community or Community: A social community of the Airspot owners.
- Host: A registered owner of an Airspot who shares bandwidth with the Airspot Community.
- Guest: User accounts that are created by the Host and are allowed to access Internet for free, on the Host's hotspot only.
- Visitor: A registered Airspot user who can access Internet at any of the Airspot locations around the country, in exchange of a fee.
- ISP: Acronym for Internet Service Provider. Typically, it is the company that provides you Internet service.
- WiFi: Acronym for Wireless Fidelity. Refers to a Wireless network in any location.
- Airspot Pass: Plan that is purchased by a Visitor or a Guest in order to be able to access Internet on any of the Airspot locations.
Subject Matter of the T&Cs
The T&Cs regulate the provision of services from Airspot to the Host, the Guest and the Visitor. Unless expressly stated otherwise, the present T&Cs, together with the registration form, Airspot's Privacy Policy and, where applicable, the Airspot Software User License constitute the contractual relationship between Airspot and the Host, the Guest and the Visitor.
Description of Airspot Services
- The Services provided by Airspot consist in facilitating access to the hotspots by providing information about the different Airspot locations; providing the authentication, registration and access to Airspot; charging the Visitors/Guests and sharing revenues with the Hosts.
- The Visitors can connect to the Airspot Community at any Airspot location.
Prior Requirements
The user that opts for the Host category, should, prior to accepting these T&Cs and before registering with the Airspot Community, have an Airspot Router.
Activation of the Airspot location
You must register with the Airspot Community through our website, providing full and correct information and indicating the category under which you register: Host, Guest or Visitor. You will have the opportunity to choose a unique username, and you must remember this username or else store it in a safe place. You must keep your password confidential.You shall communicate to Airspot regarding any modifications in the information contained in your registration form as well as any subsequent modification of such information.
Rights and Obligations of the Airspot Users
- You agree to use the Hardware, Software, Service and Airspot Access Portal, Airspot’s Privacy Policy, the Conditions for Use of the Airspot Website and Airspot Access Portal and Users License of Airspot Software in accordance with these T&Cs and accept to use them only for lawful purposes.
- Airspot reserves the right at all times to disclose any user information as Airspot deems necessary to satisfy any applicable law, regulation, legal process or governmental request.
- Airspot will remove any customized content provided by the Airspot Host through the Airspot Portal and disconnect the Airspot service if it contravenes any applicable law and if so required by the relevant Authorities.
- If you use a Airspot network, you will not invade the privacy of the Airspot Host in any way.
- For the Host
- If you register as a Host, you understand that as a result of activating and switching on the Airspot router, you will create a publicly accessible WiFi hotspot that we shall refer to as Airspot.
- 6.5.2. Other users will be entitled to access the Internet through the Airspot network. In return for your providing and maintaining this facility in accordance with these T&Cs, you will be entitled to access all Airspot networks at no extra cost. Moreover, you shall also be entitled to receive a revenue share of any connection purchased at your Airspot location by any visitor, as established in Clause 8.
- You are solely responsible for compliance with the ISP´s contractual obligations.
- You agree to use the Hardware, Software, Service and Airspot Access Portal, Airspot’s Privacy Policy, the Conditions for Use of the Airspot Website and Airspot Access Portal and Users License of Airspot Software in accordance with these T&Cs and accept to use them only for lawful purposes.
- You will have the right to grant free access to your own Airspot hotspot to several users of your choice, the exact number of which shall be defined by Airspot from time to time. Such users are called Guests, as outlined in 1.5.
- In case you do not wish to share your Internet bandwidth for public use, you are free to do so, as and when you deem fit.
- For the Guest -
If you register as a Guest, you understand that while you gain free Internet access at your Home network, you shall have no access at other Airspot locations.
- For the Visitor -
You understand that as a result of the purchase of a Airspot Pass as established in Clause 7 of these T&Cs, you will be entitled to access the Internet at the Airspot locations.
Commercial terms and conditions applicable to Visitors
- The applicable rates, including taxes, and the means of payment are mentioned in the Airspot Website and the Airspot Access Portal.
- The Visitor will need to register with the Airspot Community by providing the relevant data in order to make purchases and make payment for each Airspot Pass.
- Airspot reserves the right to change, at anytime, the prices, promotions and/or discounts for the products and services Airspot provides.
Commercial Terms and Conditions applicable to the Hosts
- All revenues (net of taxes) collected by an Airspot shall be shared with the respective Hosts at the revenue sharing rates specified in the Airspot Website.
- The settlement of amounts due will be made to the respective Hosts will be made once the revenue share payable reaches the predefined amount, as published on the Airspot Website.
Airspot Obligations
- Airspot will provide and control access to Airspot locations, authenticating and validating all Airspot users who connect through the Airspot networks.
- Airspot will register the number of users that access each Airspot network and the type of user that has accessed each of them.
- Airspot shall put in its best efforts in providing a top notch service and customer support to its customers and users.
Get an Airspot Router for Free
- The user shall have to buy the Airspot router either from Airspot, online, or from any of our vendors at the maximum retail price, that's menioned in the product sticker.
- The purchase price of the Airspot router shall be refunded to the Owner only after the completion of 6 months, from the date of purchase.
- The Airspot Owner is expected to keep the "Airspot-Public" SSID switched on, and connected to the Internet, for a minimum of 3600 hours to be eligible for this offer.
Data Protection
- Airspot will maintain the confidentiality of all personal data relating to its users, even after the termination of the Agreement. Nevertheless, while the Agreement is in place, Airspot will publish the information relating to the location/address of all Airspot networks. This is indispensable for other Airspot users to access the Airspot Community.
- In order to provide our services, we will need to share your personal data with third parties. You agree and accept that, in order to be able to provide Airspot Services, the data you provide to Airspot can be shared between companies of Airspot's Group of Companies and with contractors that are specifically hired by Airspot to provide services to us and to our users within the scope of the Privacy and Data Protection Policy as published in the Airspot Website.
Intellectual and Industrial Property Rights
- To preserve the uniform quality of Airspot Services, you must use only the official versions of the Airspot Software to provide access to our Service. You may not use the Airspot trademark on hotspots running Software versions which have been modified by persons other than Airspot.
- You accept that Airspot and the Airspot symbol, logos and graphics are trademarks of Airspot and that Airspot rights to this property are protected by law. You will immediately stop using the symbol, logos and graphics when the Agreement is terminated.
- You accept that the Hardware, Software, and Service is protected by intellectual and industrial property laws and that Airspot rights to this property are protected by law. You will observe the industrial and intellectual property rights, even after the termination of the Agreement.
Terminating or Changing this Agreement
- The agreement can be terminated by the Host by providing a 15 days notice and sending an email to unsubscribe@airspot.in or completing a form on the Website
- Airspot may terminate this Agreement at any time, for any reason, including but not limited to violation of any of the terms and conditions herein. If we wish to end this Agreement, we will inform you by email at the email address you have registered with Airspot.
- This Agreement will end immediately upon either party’s termination. However, we will continue to keep all your personal information confidential and you will continue to accept and respect Airspot´s intellectual property rights.
- We may decide to change this Agreement at any time. We expect that changes will be necessary as new features are added, and as characteristics and specifications are added to the Hardware, Software and Service. We shall communicate any change to these T&Cs one month before any such changes enter into force.
Transfer
Airspot is free to transfer or assign the benefits under this Agreement. You will be notified of any such change.
Limitation of Liability
- Airspot shall only be liable under this Agreement for losses, limited to the value of the Airspot Pass.
- While every effort is made by Airspot to provide highest quality of services to the Users, the User acknowledges that the linking quality and speed of data transmission of the the network is entirely dependent on the connectivity not attributable to AIRLINK. Accordingly, AIRLINK shall in no event be responsible to the Users for the deficiency in data transmission between the Host and Airspot network computers or for any inconvenience, damage or loss that may be caused to any one or of any kind arising there from.
AIRLINK would not be liable for any indirect, incidental, special or consequential damages or for interrupted communications, lost data or lost profits arising out of or in connection with this service, borne by the Customer, even if AIRLINK is notified of the same.
Force Majure
If any obligations under this agreement, cannot be performed due to Force Majure circumstances, beyond the reasonable control of the concerned party, and if the parties are unable to arrive at a consensus within three (3) months and if no resolution is possible, then the unaffected party may terminate the Agreement upon written notice.
Entire Agreement
This Agreement represents the final and entire agreement between you and us regarding the Service and products. Electronic images of the Agreement will be considered originals. You acknowledge that you have not relied on any other representations not specifically included in this Agreement. If we don’t enforce our rights under any of the provisions of the Agreement, we may still require strict compliance in the future. You represent that you are of legal age and have the legal capacity to enter into this Agreement. If you are contracting on behalf of a company, you represent that you are authorized to enter into this Agreement and agree to be personally liable for all accounts if you are not so authorized.
We suggest that you print out and keep a copy of these T&Cs for your records. These T&Cs shall apply to all of the Services. In addition to these T&Cs, there may be additional terms and conditions which apply to individual services which you will be required to accept when registering for that service. These T&Cs and, where applicable, the relevant additional terms that you accept as part of the registration process for Service form the entire understanding between you and us concerning your use of the Service and supersede all previous agreements relating to the Service.
Jurisdiction and Law
This Agreement is governed by and is to be construed in accordance with the laws of India and the parties hereby agree to submit to the non-exclusive jurisdiction of the Indian courts.
